Trademark Application

A trademark application is the document filed with the Patent and Trademark Office when seeking to register a mark. The application must identify the applicant, the mark and the goods/services to which the mark pertains.  The application may be based upon use in commerce of the mark or a bona fide intent to commence use in the future. Filing on the intent-to-use basis is common in order to allow the mark to start the registration process while promotional activities are still being planned and implemented.
